Agworld is committed to protecting the privacy of all personal and confidential information our customers share with us.

We encourage you to read this Privacy Policy carefully. It describes various categories of information the Agworld.com website and Agworld applications and services (including Greenbook and the www.greenbook.net website) collect and use in providing services to you and how we collect, use and protect that information. If you use our online services in any capacity, whether as a grower, agronomist, product supplier or other industry participant and whether on a free trial basis or as a subscriber you will be entitled to the protections set out in this Privacy Policy and also subject to its terms.

While using the website and services are not conditioned on your providing Agworld any specific piece of information, choosing not to provide us certain information could affect the functioning of the website and applications where those functions are related to the information withheld.

Generally, Agworld stores the information it collects, including Personal Information, in servers within the region where the customer resides. However, where that is impractical, Agworld will transfer information to secure servers that it regularly uses in other parts of the world. Agworld stores the information it collects for the duration as requested by the user or organization controlling the account, and as long as necessary for improving the website and services, and as required by law. DISCLOSURE OF INFORMATION TO THIRD PARTIES

We will not disclose or share your information with third parties except in the following circumstances, or as described elsewhere in this Privacy Policy:

Disclosure to Third Party Providers and Subprocessors. Agworld uses third-party service providers or data subprocessors to assist in providing analytics, data storage, and other services. A list of the subprocessors we use to support delivery of the services may be requested by emailing privacy@agworld.com.

Disclosure Third-Party Integrations and APIs. At your direction, we may disclose your information to third-parties with whom you have contracted to provide you separate services, through integrations and/or APIs.

Disclosure to Unaffiliated Third Parties. We may disclose your information to respond to legal requirements, to protect or enforce our rights and policies, to protect or enforce the rights of a third party, to prevent harm to a person or as required or permitted by law, including, without limitation, to comply with a subpoena or court order.

Disclosure of Non-Personal Information. We may disclose your aggregated or de-identified information to any party including potential business partners, advertisers, investors, users, and other third parties.

Disclosure to Corporate Affiliates and Successors. Agworld may disclose information, including Personal Information to its parent company, subsidiaries or other corporate affiliates, if any. If Agworld engages in a merger, acquisition, reorganization, sale of some or all of its assets, or similar transaction, or takes steps in contemplation of such transactions (e.g., due diligence), information, including Personal Information may be shared or transferred with a new or prospective owner, subject to standard confidentiality agreements.

Disclosure With Your Consent. In addition to the sharing described elsewhere in this Privacy Policy, we may share information with companies, organizations or individuals outside of Agworld if we obtain your consent to do so.

THIRD-PARTY INTEGRATIONS AND APIS

As noted above, Agworld offers its users the opportunity to use and transfer information to third-party service providers within the application. Agworld will only do this at your direction and with service providers you have a direct relationship with. Accordingly, Agworld does not control how those providers collect and use the information you transfer to them. You should only transfer information from our applications to service providers whose privacy practices meet yours and your organizations standards. Further, many individuals may have their Personal Information transferred from Agworld to third-party service providers at the request of the employer or organization that created the account for that individual. Employer account holders are in control of their employee’s Personal Information and individuals who have had their data transferred to third-parties by their employer’s account should address any issues they have concerning such transfers with their employers and with the third-parties their employers directed that information be disclosed.

AGGREGATED AND NON-PERSONAL INFORMATION

We collect and aggregate data and information, including agricultural data, from a number of sources. That data and information help us among other things to identify and analyze trends, set benchmarks, observe customer behaviour, participate in research and development programs and improve our products and services. That data and information are aggregated so that no individuals nor their farm and business operations can be identified, and so that none of their specific Personal Information can be ascertained.

Examples of such data which we include as aggregated information include crop types, levels of pest infestation and reported crop diseases and long range weather and climate patterns, in each case across counties, regions, states and countries.

If you are not comfortable with your data and information, including any agricultural data you provide us, being included in any aggregated information then you can elect to opt-out of the collection and use of your data and information for such purposes on the opt-out terms more particularly set out in the then-applicable contract between you (or your employer) and Agworld (or, as applicable, by exercising the appropriate data subject rights in the relevant jurisdiction, if any). COOKIES AND ANALYTICS; DO NOT TRACK

In operating our website and applications, we may use a technology called "cookies." A cookie is a piece of information that the servers that host our website and applications give to your browser when you access the website and applications. We also use other, similar technologies including “tags” or “pixels” which are pieces of website code that operate similar to cookies. Our cookies help provide additional functionality to the online services and help us analyze online services usage more accurately. For instance, our site may set a cookie on your browser that allows you to access the website without needing to remember and then enter a password more than once during a visit to the site. This website does not respond to Do Not Track (“DNT”) signals. Third-party applications and plugins, such as social media integration, may treat DNT signals differently.

DATA PROTECTION

We have in place a range of industry standard measures to protect your information. Those measures include technical and security features which are regularly audited, reviewed and updated. Our staff are also trained and educated in data protection and privacy practices and policies.

Before we give you access to any of our online services you will generally need to take steps to verify your identity. You are entirely responsible for maintaining the confidentiality of your password and access codes.

EUROPEAN UNION DATA SUBJECTS AND THE GDPR

General Data Protection Regulation. The GDPR provides certain rights to online users located in European Union countries (“EU Data Subjects”). An EU Data Subject has the right to access or rectify their Personal Information that Agworld processes. Subject to certain exceptions, an EU Data Subject has the right to request that Agworld erase that Personal Information or restrict the processing of it. When technically feasible, Agworld will, at the EU Data Subject’s request, provide that person’s Personal Information to them or transmit it directly to another data controller. EU Data Subjects also have the right to file a complaint with the appropriate data protection authority. EU Data Subjects may exercise their rights, and ask any other related questions, by emailing privacy@agworld.com.

Agworld relies on the legitimate interests (except as where otherwise noted, such as in the cookie consent banner below) described above for processing EU Data Subjects’ Personal Information including: providing the requested agricultural business and farm management services through the website and mobile apps, improving the website, application, and services, and providing third-party integrations at the users’ direction.

To comply with the GDPR’s requirements, Agworld collects and transfers EU Data Subjects’ Personal Information to other countries outside the European Union only: (1) consistent with an adequacy decision under Article 45 of the GDPR; (2) pursuant to suitable safeguards; or (3) consistent with another permissible transfer mechanism where appropriate. CALIFORNIA SHINE THE LIGHT LAW

Under California’s “Shine the Light” law, California residents who provide Personal Information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us a calendar year information about the information we shared, if any, with other business for their own direct marketing uses. If applicable, this information would include the categories of information and the names and addresses of those businesses with which we shared information for the immediately prior calendar year (e.g. request made in 2020 will receive information regarding 2019 sharing activities).

To obtain this information, please send an email message to privacy@agworld.com with “Request for California Privacy Information” on the subject line and the in the body of your message. We will provide the requested information to you at your e-mail address in response. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response.

OTHER RIGHTS YOU MAY HAVE

Individual users may have similar or additional privacy rights under applicable law, such as the right to access or correct their information. If your organization, such as your employer or service provider, provides you access to and is administering your use of Agworld’s services, contact your organization to learn more about how to access and control your information. We are not responsible for the privacy or other practices of third parties which operate sites which are linked to our online services. We also accept no responsibility for the content of those sites. If you do use any such sites we encourage you to check the data protection and privacy policies which apply to their use and operation.

USE OF OUR ONLINE SERVICES BY CHILDREN

Neither the website nor the applications are directed to children under the age of 18. If we learn that we have collected Personal Information from a child under the age of 18, we will promptly delete that information. UPDATES TO THIS PRIVACY POLICY

We may make changes to the Privacy Policy from time to time. We will notify you of any material changes by sending you an email, posting a notice on the home page of the website, or posting a notice in your account.
